Former Leader of Opposition in Parliament, Mathias Mpuuga is drawing close to tabling motions seeking leave of Parliament to table private member’s Bills aimed at causing electoral reforms ahead of the 2026 general elections.
Mpuuga, Member of Parliament for Nyendo-Mukungwe Division in Masaka City and a Commissioner of Parliament has already sought space on the Order Paper by officially submitting the notices of motion to Speaker Anita Among.
In a move that is likely to see a protracted battle with the Government which has for years promised a Constitutional Review Commission to study and make proposals to amend the Constitution, Mpuuga wants to amend the Constitution, the Presidential Elections Act, 2005, the Parliamentary Elections Act, 2005, the Electoral Commission Act, the Local Governments Act and the Referendum and other Provisions Act.
“This is to request for space on the Order Paper for their (Bills) consideration by the House,” Mpuuga noted in a letter dated October 4, 2024.
Likely to become one of the controversial proposals because it affects majority of the legislators, Mpuuga wants to table the Constitutional Amendment Bill to provide for propositional representation which would see the size of Parliament reduced if passed. In this Bill where Bugabula South MP, Henry Maurice Kibalya is the seconder, Mpuuga has also proposed for; a bicameral legislature and reinstatement of Presidential term limits.
By amending Article 74, the legislator wants to see the abolition of Constituencies with by ensuring that each District or City is represented by one directly elected MP and a woman MP. This proposal if approved would see Parliament size reduced from the current 529 elected MPs to 342.
A new Article (78A) has been proposed to provide for the establishment of the Senate whose composition would include; members directly elected to represent 39 Districts specified in the Third Schedule A which were existing at the promulgation of the 1995 Constitution. The Senate is proposed to have a Majority Leader appointed by the President and a minority leader who shall be an ex-officio member without the right to vote.
Still in the proposed National Assembly, the mover wants to see the creation of a Speaker’s Panel comprising of two legislators one of who is from a party in the opposition and these would be mandated to preside over the House in the absence of the Speaker and Deputy Speaker. The need for establishment of a Speaker’s Panel was first mooted in the 10th Parliament.
Another change is being mooted to Articles 98, 100, 103 of the Constitution to substitute the Vice President with a Deputy President who would be a running mate to the Presidential candidate during elections.
Under Article 104, the mover wants to cause an amendment to stop restricting Presidential elections petitions challenge results of a presidential election to only aggrieved candidates but to any aggrieved registered voter.
Other Constitutional amendments proposed are legislators appointed Minister to resign their positions as MPs; and, insertion of new Articles to provide for the functions of Deputy President, and removal of a Deputy President.
“The Vice President appointed under Article 108 of the Constitution, by the President with approval of Parliament by simple majority, lacks the mandate of the general public given the nature of appointment, yet a Deputy President who is subjected to an election as a running mate of a presidential candidate obtains public trust and is accountable to the public, hence the need to replace the Vice President with a Deputy President, “ reads part of the motion.
Seconded by Joyce Bagala, Mityana District Woman MP and Richard Lumu, MP for Mityana South, Mpuuga is seeking to amend the Political Parties and Organisations Act, 2005 to provide for legal framework for coalitions during elections. The current legal framework does not provide for coalitions or merger of political parties for purposes of gaining momentum to challenge in general elections like is the case in neighbouring Kenya.
If granted leave, Mpuuga wants to propose that Section 17 of the principal Act be replaced to provide for merger of political parties which would see the original parties or organisations dissolved upon registration of the new party or organisation. The Electoral Commission would register the new party after the merger agreement is deposited to it within 21 days of its signing.
On formation of coalitions, the mover wants to replace Section 18 of the principal Act to provide for a coalition of two or more political parties or organisations at any time they so wish by entering a coalition agreement. While the coalition agreement would be deposited in the Electoral Commission, the proposal is that it has to have a name, parties to the coalition, the role of governing bodies of each party and a specific duration, among others.
In the draft Electoral Commission (Amendment) Bill, 2024 Mpuuga who will be seconded by Rose Fortunate Nantongo, Kyotera District Woman MP, wants to amend Section 12 of the principal Act to provide for prisoners and Ugandans abroad to vote in the general elections. He wants to introduce a new Sections in the law to provide for the mechanism of registering Ugandans abroad and also gazetting Embassies, Missions and Consulates to be polling stations on the Election Day, with election officers being designated by the Minister of Foreign Affairs.
He believes that by providing for the legal framework on participation of the prisoners and Ugandans abroad in the elections will save the Electoral Commission from further condemnation by the Courts of allow for not allowing those categories of Ugandans to vote.
“The Electoral Commission Act, Cap. 176 has been affected by various decisions of Court, including the decision in Kalali Stephen Vs Attorney General & Electoral Commission (Misc. Cause No. 35 of 2018) when the High Court directed that prisoners and persons abroad have a right to vote. Court faulted the conduct of the Electoral Commission of denying prisoners and persons resident abroad from exercising their right to vote. The Bill therefore seeks to give effect to Articles 1, 59, 21 of the Constitution by empowering prisoners and Ugandan citizens abroad to participate in elective politics,” reads part of the Bill.
In the proposed Parliamentary Elections (Amendment) Bill, Mpuuga with secondment from Asuman Basalirwa, MP Bugiri Municipality, wants to see that after the Districts and Cities electing their representatives, 50 more be seconded to the House by their political parties and these who included special interest groups.
The Commissioner of Parliament with the backing of Mukono South MP, Fred Kayondo has proposed one amendment in the Local Governments Act in Section 7 to get rid of the a County council since the same was eliminated by a Government policy.
While Uganda last conducted a referendum in the early 2000s to return the multiparty system, Mpuuga together with Mbwatekamwa Kakembo, MP Entebbe Municipality has seen a defect in the current law and now seeks to amend the Referendum and Other Provisions Act. Their proposal is that the Electoral Commission be empowered to organise a referendum on the same day with the Presidential, Parliamentary and Local Governments Councils’ elections.
Previous reforms
The last time Parliament passed electoral reforms was in March 2020 with much emphasis put on the electoral process other than changing the structure of Government and composition of Parliament as it in the proposed legislations. The most significant reform at the time was the amendment of the Electoral Commission Act to provide for electronic transmission of results by the District Returning Officer to the National Tally Centre.
